Authority to serve in each state
Although our committee has had no meetings recently, we have been working in the background on assembling the laws in each state concerning who has authority in that state to receive and serve documents coming from another state. We have had problems with some members receiving documents from a state that has laws stating who has authority to serve a paper going to another state. The receiving party has served the documents not having the authority to serve those documents - thereby causing a problem with the service in the originating state.
These guidelines are in the final stages of being revised and written and will be mailed out in the near future.
